Learned counsel for the petitioner submitted that the issue involved in the present petition is squarely covered by the decision of this Court in the case of Nand Kumar Agarwal and another Vs. State of U.P. and others, reported in 2009 (3) AWC 3118 wherein it has been held that the definition of lease as under the Stamp Act to be looked upon for the purpose of chargeability of stamp duty.

The matter requires consideration.

Learned Standing Counsel prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.

List immediately thereafter.

Till the next date of listing, the realization of the demand shall remain stayed.
