Issue notice to file counter affidavit within six weeks. Rejoinder affidavit may be filed within a period of two weeks thereafter. List in the first week of August, 2010.
As per Sri B.Dayal, learned counsel for the Meerut Development Authority, the site where the respondent wants to construct his service garage is earmarked in the Master Plane to the Bus Station. Under the relevant provisions contained in the U.P. Urban Planning and Development Act, 1973 no such construction is permitted. The civil court has given indulgence. It has declined to stay the proceedings despite the legal provisions brought to its notice.
In view of the above, further proceedings in suit No. 491 of 2008- Yogendra Vs. Meerut Development Authority pending in the court of Addl. Civil Jdge (Senior Division) Court No.1, Meerut shall remain stayed until further orders of the Court. The revisionist Meerut Development Authority, Nagar Nigam and the concerned police authority shall also ensure that no encroachment shall be made on the plot area earmarked for Bus Station for public amenities as per Master Plan of the Meerut city.
