Heard Sri Abhay Kumar Dwivedi, learned counsel for the applicant and Sri Prashant Kumar, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to direct the court below to hear and decide the Complaint Case No. 2043 of 2010, under Section 12 of the Domestic Violence Act, P.S. Shahpur, District Gorakhpur pending before learned Additional Chief Judicial Magistrate, Gorakhpur expeditiously within short span of time.
Learned counsel for the applicant states that the present case under Section 12 of the Domestic Violence Act has been filed in the year 2010, since thereafter, the proceedings of the case are not going on, hence, a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a time limit which is prescribed under Section 12 sub-clause (5) of the Domestic Violence Act itself without permitting undue adjournments to either sides, if there is no legal impediment.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
