This Writ Petition is filed for a direction to the respondents to effect mutation in respect of the property covered in Re-Sy. No. 80/17-3 of Pattimattom Village of Kunnathunadu Taluk.
2. The learned Government Pleader, on instructions, submitted that the revenue recovery proceedings were initiated against the vendors of the property and this property is liable to be proceeded under the Revenue Recovery Act.
In view of the matter, any right available to the creditor will not be lost merely for the reason that the transfer of registry is effected. Therefore, subject to any right available to the creditor, W.P. (C ) No. 25719 of 2014 2 transfer of registry shall be effected based on Ext.P5. It shall be done within a period of two weeks from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of as above.
