JUDGMENT / ORDER

1. Petitioners have approached this Court seeking for compounding the so-called violation in respect of putting up bore well. The facts would disclose that the petitioners were given permission to put up bore well. But, it seems that the petitioners did not put up bore well at the place identified by the Ground Water Department, whereas it is constructed in another area in the same premises. According to the petitioners, if there is violation, the Ground Water Department is entitled to penalise them by way of imposing penalty.
2. Learned Government Pleader, on instructions, submits that no such request has come from the side of the petitioners and unless they request for the same, the authorities cannot take further W.P.(C)No.13597 of 2014 -:2:-
action in the matter.
In such circumstances, this writ petition is disposed of as under: If the petitioners make necessary representation before the respondent for making suitable changes in the alignment fixed for digging the bore well, it shall be considered by the respondent and appropriate orders passed, within a period of six weeks from the date of receipt of a copy of this judgment.
A.M.Shaffique, Judge.
