JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) Learned AGP filed affidavit dated 27.3.2012, sworn by respondent no.2 herein. Along with such affidavit, respondents have produced an order dated 11.2.2012 by which representation of the present applicant came to be disposed of.
We notice that by order dated 14.7.2011, Learned Single Judge had while disposing of Special Civil Application No.5736/2011 directed the respondents to reexamine the representation of the applicant petitioner. This having been done we are not inclined to take any further steps in this contempt petition.
We notice that the decision of the authority is adverse to the applicant. It is always open for the applicant to challenge the same in accordance with law. We notice that in the order dated 14.7.2011 passed by Learned Single Judge, direction was to consider representation bearing in mind Government Resolution dated 29.3.2007. From the order passed by the authority, we notice that such Government Resolution along with other documents has also been referred to.
We may record that learned advocate Shri B.S. Brahmbhatt previously appearing for the applicant has expired. However, in view of the developments noted above, this contempt petition is disposed of leaving it open for the applicant to file appropriate proceedings challenging the order passed by the authority.
Since the oder is passed ex-parte, it would be open for the applicant to apply for revival of contempt petition, if so found necessary.
