This Civil revision petition is filed challenging the order passed by the Court below in C.M.P.No.944 of 2016 filed by the respondents 1 to 4 as third parties under Order 41 Rule 3(A) of C.P.C. for condoning the delay of 343 days in preferring the appeal against the judgment and decree passed in O.S.No.10802 of 2009.
2 In the light of the order passed by this Court in C.R.P.(NPD) No.3814 of 2017, the impugned order passed by the learned Principal Judge, City Civil Court, Chennai in C.M.P.No.944 of 2016 is hereby set aside. It is open to the parties concern to file appropriate application before the Court below based on the outcome of the order passed in I.A.No.943 of 2016 before the Court below, if necessary at later stage. 3 Accordingly, the Civil revision petition is disposed of with the above observation. No costs. Consequently, connected miscellaneous petition is closed.
