This Petition coming on for Preliminary Hearing in ‘B’ Group, this day, the Court made the following:-
ORDER None for the parties.
In this petition, the petitioner inter-alia has prayed for the following reliefs:
“a) Issue Writ in the nature of Mandamus and issue directions to Respondent to consider the Representation dated 03.12.2016 submitted by the Petitioner under Annexure-J;
b) Issue directions to the Respondent, pending consideration of the Representation dated 03.12.2016 submitted by the Petitioner under Annexure-J, not to proceed with any kind of recovery action against the schedule property; and c) Issue such other Writ, order or direction/s as may be deemed fit to grant in the given circumstances of the case in the ends of justice and equity.”
2. After perusal of the records, I deem it appropriate to dispose of this writ petition with a direction to the competent authority to consider and decide the representation dated 03.12.2016 submitted by the petitioner, if not already decided, in accordance with law. Needless to state that the aforesaid order shall be passed after affording an opportunity of hearing to necessary parties. Ordered accordingly.
