Heard learned counsel for the petitioner and learned Standing Counsel for respondents no.1 & 2.
The husband of petitioner namely Yogesh Srivastava was Gram Panchayat Adhikari and had retired on 31.12.2016. Her husband had died on 23.05.2019. The petitioner, by means of present writ petition, has prayed for following reliefs:-
"i) issue a writ, order or direction in the nature of mandamus directing the respondent No.2 to given all benefits (family pension, G.P.G. etc.) to the petitoner in respect of her deceased husband Yogesh Srivastava who rendered services from 14.07.1984 to 31.12.2016 with interest within specific period fixed by this Hon'ble Court.
ii) issue a writ, order or direction in the nature of mandamus directing the respondent No.2 to decide the representation of the petitioner dated 06.08.2021 (Annexure No.7 to this writ petition) within stipulated period which is pending before respondent No.2."
The grievance of the petitioner is that neither the competent authority has considered the representation of the petitioner nor has paid the aforesaid retiral dues of her husband to her.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.2 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed of with direction to the petitioner to file a fresh representation before the respondent no.2-District Panchayat Raj Officer, District Kanpur Nagar, raising all her grievances within a period of two weeks from today. In case any such representation is filed, the respondent no.2 shall consider and decide the same by a reasoned and speaking order within a period of two weeks thereafter.
With the aforesaid observations, the writ petition is disposed off. Order Date :- 17.12.2021 SS
