The petitioner has applied for grant of free hold rights over the Nazul land-Arazi Nos. 40, 41 and 43 area 13.5 decimal, situate at Gram Harpur, Pargana Ballia, District Ballia.
The grievance of the petitioner is that the aforesaid application for grant of free hold rights has not been considered by the District Magistrate, Ballia-respondent no. 3. The petitioner in that regard submitted representations dated 24.5.2016 and 23.1.2018 to the District Magistrate.
Since the matter of grant of fee hold rights over the Nazul property are to be dealt with by the District Magistrate and he cannot keep the matter pending indefinitely, we dispose of the writ petition directing the District Magistrate to consider and decide the aforesaid representation of the petitioner in accordance with law, most expeditiously, if possible, within a period of three months and thereafter proceed to deal with the free hold application of the petitioner.
