Heard learned counsel for the petitioner.
Present petition has been filed for setting aside the order dated 22.1.2018 passed by District Judge / Motor Accident Claims Tribunal, Etah in Transfer Application No. 191 of 2017 (Meena Rajpur vs. Smt. Soni and others).
By the order dated 22.1.2018 the transfer application filed by the claimant-petitioner has been rejected.
Submission of learned counsel for the petitioner is that the respondent no. 1 is deciding the cases of the learned counsel for the petitioner in arbitrary manner and with mala fide intention and therefore, the order dated 22.1.2018 is liable to be set aside and the proceedings are liable to be transferred to some other court.
I have considered the submissions and have perused the record.
I do not find any legal infirmity in the order impugned herein, whereby the transfer application has been rejected with the observation that simply because two claim petitions have been decided by the court on merits to which the counsel appearing for the petitioner is not satisfied, does not mean any ground to transfer the case.
Present petition lacks merit and is accordingly dismissed.
