The following prayer has been made in the instant petition:-
"i) Issue an order or direction in the nature of certiorari to set aside the entire proceeding of execution bearing execution case No.231 of 2018 arising out of judgement and order dated 16.03.2018 passed by Additional District Judge, Court No.1, Kanpur Nagar in as SCC case No.171 of 2012 (Arun Kumar Jaiswal Vs. Mahesh Prasad Gupta and others) under section 21 (1) (A) U.P. Act No.13 of 1972."
The relief claimed is wholly misconceived, as there cannot be single execution proceedings for execution of a decree passed in SCC suit, as also for execution of a release order under Section 21 (1) (a) of U.P. Act No.13 of 1972.
The petition is accordingly dismissed.
