Heard learned counsel for the petitioner and Sri H.C. Dubey, learned Standing Counsel appearing for the respondents.
Present writ petition has been filed seeking quashing of the impugned order dated 11.12.2018 passed by the Assistant Commissioner of Stamps, Prayagraj/Allahabad. A further prayer in the nature of mandamus directing the respondents to rehear the petitioner on review/recall application moved properly against the order dated 18.4.2018 passed by the Assistant Commissioner of Stamps, Prayagraj/Allahabad.
By means of the aforesaid order, the review application filed by the petitioner has been rejected.
After some argument, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition with liberty to challenge the order dated 18.4.2018 passed by the respondent no. 2, the Assistant Commissioner of Stamps, Prayagraj/Allahabad under Section 56 of the Indian Stamp Act in accordance with law.
Present writ petition stands dismissed with liberty to the petitioner to avail remedy under Section 56 of the Indian Stamp Act, strictly in accordance with law. However, it is observed that in case the appeal is filed with necessary deposit etc, in accordance with law within a period of 15 days from today alongwith a certified copy of this order, the same shall be entertained without raising any objection regarding limitation.
No costs.
