This application under Section 482 Cr.P.C. has been moved seeking quashing of the order dated 30.01.2018 passed by C.J.M., Allahabad in application No. 108/XII/2018 (State of U.P. Vs. Sukkhu Nishad) in Case Crime No. 287 of 2017 under Sections 147, 148, 149, 307, 120-B, 302 I.P.C. P.S. Daraganj, District Allahabad and also prayer is made that police authorities be directed to conduct NARCO Test of the accused applicant's son i.e. Sukkhu Nishad.
Learned counsel for the applicant contends that learned court below has not taken into consideration the facts of the case and the prayer made by the accused applicant before it regarding direction to the investigating agency to conduct NARCO Test of the accused Sukkhu Nishad.
Perused the impugned order.
In the said order, it is mentioned that according to the report of the prosecuting officer, there was sufficient evidence against the accused, Sukkhu Nishad for submitting charge-sheet which has already been submitted before court on 19.12.2017 and, therefore, no force was found in the request made for directing narcotic test to be conducted by the police agency.
This Court does not find any infirmity in the said order because ordering such kind of test would amount to interference in investigation.
This application is finally disposed of.
