THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.28990 OF 2014 ORDER:
Heard Sri P.V.V.Gopala Krishna Murthy, learned counsel appearing for the petitioner and Sri K.Laxmi Narasimha, learned standing counsel for Andhra Bank, appearing for the respondents.
This writ petition is filed for a mandamus, declaring the action of the respondents in not considering the candidature of the petitioner for the vacancies of sub-staff in various branches of the respondent bank as arbitrary, illegal, unlawful, unfair, unconstitutional and violative of articles 14 and 21 of Constitution of India and consequently direct the respondent bank to consider the candidature of the petitioner for appointment to the cadre of sub-staff.
The petitioner joined in the respondent bank as temporary sub-staff in January, 1995. In the year 2002, he represented to the respondent bank to regularize his services and he was orally informed not to attend the duties in the bank. Since then, he has been making several representations to the bank to take him back to service as sub staff, but there was no response from the respondents. The representations of the petitioner include the one made on 25-11-2013. It is further submitted that a communication was issued by the Human Resources Department of the respondent Bank on 12-2-2014 stating that the bank is going to examine the matter of vacancies of 1000 sub-staff in pursuance of the points raised by the workmen of the respondent bank in the 93rd Industrial Relations Committee Meeting dated 26- 12-2013.
Under the aforesaid circumstances, the petitioner filed the present writ petition to issue a direction to the respondent bank to consider his case for the post of sub- staff while filling up the 1000 vacancies.
Considering the fact that the petitioner rendered service to the respondent bank as sub-staff for several years, the third respondent is directed to consider the representation made by the petitioner, seeking appointment as sub-staff, subject to his eligibility to the aforesaid post and vacancy position.
The writ petition is accordingly disposed of at the stage of admission. There shall be no order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
