HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.22064 of 2014 ORDER:
The petitioners are the owners of lands to an extent of Ac. 5.30 cents in Survey No.713, Ac. 2.10 cents in Survey No.714-B and Ac. 0.10 cents in Survey No.714-A of Kalikiri Village and Mandal, Chittoor District. The petitioners intend to dispose of the said lands and when they approached the Sub-Registrar, Kalikiri, Chittoor District (3rd respondent) to ascertain the market value of the lands, the third respondent refused to furnish the market value. Hence, this writ petition.
2. Learned counsel for the petitioners submits that the third respondent cannot refuse even to furnish the market value without assigning reasons. However, as it appears, no written request was made by the petitioners requesting the third respondent to furnish the market value.
3. In the facts of this case, the Writ Petition is disposed of granting liberty to the petitioners to make a written request to the Sub-Registrar, Kalikiri, Chittoor District (3rd respondent) to furnish the market value of the property and on receiving such request, the third respondent shall furnish the market value and if the third respondent has a valid reason for not furnishing the market value, he shall assign the reasons and communicate the same to the petitioners. If there is any list of properties communicated by the Government showing it as prohibited properties, the same also shall be furnished to the petitioners. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
