This Court on 04.05.2012 passed the following order:
"Today, the matter was called out twice. A request is made for keeping this matter on 07.05.2012. The learned counsel for the Union could not explain the uncanny delay in registering the document. An attempt was made to explain that there cannot be straightway mandatory registration once the objections are overruled, as Section 23 is subject to provision of 19. However, no affidavit or any other documentary evidence or even instructions could be cited to indicate any existence of even remote possibility of invoking Section 19.
Apropos Shri Soparkar learned Sr. counsel invited this Court's attention to document at Annexure D, which is status report obtained from the Website in which the status of this application is shown to be appeal. Therefore, it was canvassed on behalf of the petitioner that now there exists no action contemplated at the end of respondent no.2. In view of this, petition may allow.
The Court may would have acted in view of the order dated 20.04.2012 and the fact that notice of this Court is received by respondent no.2.
At the request of learned counsels one day time is unreasonable, hence, it is kept on 07.05.2012. No further time shall be granted."
Today, learned ASG Shri Champaneri submitted that the Court may dispose of this matter as looking to the records and instructions received, there appears to be no hurdle in processing the registration as expeditiously as possible i.e within 1 (one) week from today as there appears to be no prohibitory orders from the Appellate Forum also.
In view of this statement, this petition is disposed of as having become infructuous as registration is to be processed within 1 (one) week from today. However, liberty to file fresh petition to the petitioner only, in case of difficulty. Notice discharged. No costs.
