Order: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This Public Interest Litigation is filed purporting to be a fresh action as it was dismissed on 9.6.2014 with liberty to file afresh and this petition is filed praying for the following reliefs:
“to issue an appropriate writ, order or direction one in the nature of Writ of Mandamus (i) the action of the respondent in shifting one after one all departments District Head Quarters from Medak Town to Sanga Reddy Town and establishing District Head Quarters at Sangareddy Town and neglecting Medak Town as illegal, arbitrary, violation of Article 21 of the Constitution of India and principles of natural justice and consequentially direct the respondents to promote the Medak Town as Head Quarters of the Medak District apart from the existing district head quarters at Sangareddy Town; (ii) costs may be awarded and pass such other orders.”
Going by the statements and averments made in the petition, we are of the view that this is an absolute policy decision of the Government where the District Headquarters should be situated and located. The Court cannot issue any mandate.
We, therefore, dismiss this Public Interest Litigation. However, we grant liberty to the petitioner to make a representation to the appropriate authority.
Consequently, the miscellaneous applications, if any pending, shall also stand closed. No order as to costs.
