A supplementary affidavit filed today, be taken on record.
By order dated 11.04.2018 in Writ-A No. 9776 of 2018 filed by the applicant, this Court directed the opposite party to decide the claim of the petitioner within four months from the date of communication of certified copy of the order.
Counsel for the applicant points out that a certified copy of order of the Writ-Court was communicated to the opposite party by registered post on 21.04.2018 followed by reminder dated 31.08.2018 but no decision has been taken in the matter so far.
This Court is of the opinion that before noticing the inaction on part of the opposite party in considering the claim of the applicant and the same is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order alongwith fresh representation before the opposite party and in that event, the opposite party shall ensure that the decision must be complied as issued by the Writ-Court within next two months. In case the decision is not taken, as directed herein, it shall be open to the applicant to initiate fresh contempt proceedings against the opposite party.
