JUDGMENT / ORDER

The prayer in the writ petition is for a Writ of Mandamus, directing the 3rd respondent to place the Petitioner's seniority in Serial No.3 in pursuant to the proceedings dated 25.08.2008, and to promote the petitioner's service to the cadre of Road Inspector (Grade-II).
2.Heard both sides.
3.Though the petitioner has come out with the present writ petition with the above said prayer seeking promotion as Road Inspector (Grade-II) by treating the 5 days period availed by the petitioner as duty period during the training period from 10.11.1997 to 09.11.1998, he has already given a representation to the first respondent on 20.09.2008 and in the said representation he had requested the first respondent to consider his request to treat the five days period availed by the petitioner as a duty period and he shall be considered for promotion to the post of Road Inspector (Grade ? II).
4.In view of the above said facts and circumstances of the case, this Court without going into the merits of the Writ Petition, directs the first respondent to consider the said representation dated 20.09.2008, given by the petitioner and decide the same on merits and in accordance with law and pass orders on the plea raised by the petitioner for promotion to the post of Road Inspector (Grade ? II) within a period of eight weeks from the date of receipt a copy of this order.
5.This Writ Petition is disposed of with the above direction. No costs.
