None present for the petitioner. Learned counsel, Mr.Shirish Trivedi submitted that the petitioner has passed away since long and a copy of his death certificate is submitted and placed on record to show that the petitioner has passed away on 18.9.2006. Even thereafter no application is made to bring heirs of the petitioner on record, if the petition were to be pursued. Therefore, the petition is unnecessarily surviving, according to his submission. Having regard to above facts and circumstances, the petition is disposed as dismissed and Rule is discharged with no order as to costs.
