JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE OF ANDHRA PRADESH AT HYDERABAD TUESDAY, THE TWENTY SECOND DAY OF APRIL TWO THOUSAND AND FOURTEEN :PRESENT:

Md. Moti Shaik, S/o.Tamsuddin, AND . Petitioner/A-2 State of A.P., rep. by its P.P., High Court of A.P., Hyderabad, through Police Station, Medipally . Respondent Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail during the trial in Cr. No. 86/2014 on the file of the Medipally Police Station, Cyberabad, R.R. District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri M.Subba Reddy, Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“The petitioner is A-2. He seeks for grant of bail. He allegedly committed offences under Sections 489-B and 489-C IPC. In all four counterfeit currency notes of Rs. 1,000/- denomination were found in the possession of the petitioner.
In view of the quantity of the contraband seized from the petitioner, I consider it appropriate to enlarge the petitioner on bail. However, in view of the forthcoming elections, which are schedule to take place on 30.4.2014, I consider it appropriate to enlarge the petitioner on bail subsequent thereto only.
Consequently, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to the satisfaction of the learned III Metropolitan Magistrate, Cyberabad at L.B. Nagar.
The solvency of the petitioner can be considered for acceptance on or after 2.5.2014 only. After his release, the petitioner shall appear before the SHO, Medipally Police Station, Cyberabad on every Monday, Wednesday, Friday between 9.00 AM and 6.00 PM for a period of three months.”

No. 3939 of 2014 is corrected as “489-B and 489-C IPC and also “XII Metropolitan Magistrate is corrected as “III Metropolitan Magistrate” as per the order of the Court dated 28-04-2014 made in Crl.P. MP. No. 5009 of 2014. Substitute this amended order in place of the previous order which was already dispatched on 22- 04-2014.
