THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.30239 OF 2014 ORDER:
Heard Sri V.Narsimha Goud learned counsel appearing for the petitioner and the learned standing counsel for APSRTC., appearing for the respondents.
This writ petition is filed under Article 226 of the Constitution of India, seeking a writ of mandamus in the nature of a direction to the respondents to consider the case of the petitioner for compassionate appointment.
The petitioner’s father Md.Maqsood Ali was a driver in APSRTC., and he died in harness due to heart attack on 30-3-2002. Thereafter, the petitioner’s mother made an application on behalf of the petitioner to provide compassionate appointment to the petitioner as conductor or shramik. The respondents negatived her request on the ground that the petitioner had not passed SSC examination.
It is submitted by the petitioner that he passed SSC examination in the year 2003 and certificate was issued to him on 1-5-2003 and now he is qualified for the post of conductor or shramik. For some time, he was not provided compassionate appointment on the ground that there was a ban. Subsequently, the Government of Andhra Pradesh issued G.O.Ms.No.2, dated 5-1-2013 limiting the scheme to the dependents of the employees who died between 1-1-1998 and 31-12-2010. Subsequently, G.O.Ms.No.15, dated 7-2-2014 was issued extending the benefit to the persons who died even after 31-12-2010. In view of the above, the petitioner claims that he is eligible for appointment on compassionate grounds. He also issued a legal notice dated 20-09-2014 requesting the corporation to provide him a job of conductor or shramik under bread winner scheme, but so far he has not been provided any job.
Having regard to the aforesaid submissions, the respondents are directed to consider the case of the petitioner for appointment as conductor or shramik on compassionate grounds in terms of G.O.Ms.Nos.2 dated 5-1-2013 and G.O.Ms.No.15, dated 7-2-2014 within a period of two months from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly at the stage of admission. There shall be no order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
