HONOURABLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.17902 OF 2014 ORDER:
Heard the learned counsel for the petitioner and the learned Standing Counsel for the second respondent-Wakf Board.
2. The petitioner states that he is desirous of taking property of the Wakf Board on lease for establishment of godown. He made an application to the second respondent-Wakf Board for allotment of Ac.1.00 of land in Survey No.253 of Kurnool. The second respondent received the said representation and called for a report from the Inspector Auditor, Wakfs, Kurnool. The Inspector Auditor submitted his report to the second respondent vide Letter No.102/KNL/2011, dated 03.10.2013. However, no action is taken thereon so far. Hence, the petitioner approached this Court seeking a direction to the second respondent to take appropriate decision, after considering the report submitted by the Inspector Auditor.
3. Though the matter was adjourned twice to enable the learned Standing Counsel to get instructions, even today a request is made for further adjournment. I am not inclined to grant any further adjournment.
4. The second respondent is required to act in accordance with law while considering the request of the petitioner, since the Inspector Auditor, Wakfs, Kurnool, has already submitted the report.
5. Hence, the Writ Petition is disposed of directing the second respondent to take a decision in the matter in accordance with the Wakf Act, 1995 and the Rules made thereunder, as expeditiously as possible, in any case within a period of three weeks from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
