ORDER:
This Writ Petition is filed for a mandamus to declare tender notification No.C1/122(4)/14-RM:NZB, dated 19-6- 2014 of respondent No.2 as illegal and arbitrary.
I have heard the learned Counsel for both the parties at length on 14-10-2014.
At the previous hearing, Sri N. Vasudeva Reddy, learned Standing Counsel for the A.P. State Road Transport Corporation invited this Court’s attention to the averments in para-9 of the counter-affidavit of the Law Officer of respondents-Corporation wherein it is stated that as per Board’s resolution No.133/2007, dated 24-10-2007, the petitioners will be given first preference if they are ready to pay the licence fee quoted by the highest bidder in the present tender process and the stalls will be allotted to the petitioners.
Sri O. Manohar Reddy, learned Counsel for the petitioners, has taken an adjournment to today for getting instructions on the said offer. Today, at the hearing, the learned Counsel has submitted that his clients are willing to accept the said offer of the respondents-Corporation.
The learned Standing Counsel stated that as the petitioners have agreed for the offer referred to above, the licences will be extended for a period of another five years as stipulated in the present tender notification.
Having regard to the above submissions of the learned Counsel for the parties, the Writ Petition is disposed of with the direction to the respondents to extend the licences of the petitioners for another term of five years subject to the latter offering to pay the highest bids received in pursuance of the present tender notification.
As a sequel to the disposal of the Writ Petition, interim order dated 2-7-2014 is vacated and WPMP No.22732 of 2014 and WVMP No.1987 of 2014 are disposed of as infructuous.
