ORDER:
The short grievance of the petitioner, who is the existing Fair Price Shop dealer of Shop No.5505 of Bayyaram Village, Kataram Mandal, Karimnagar District, is that pending the appeal before respondent No.4, respondent No.2 has been proceeding with filling up of the vacancy created due to bifurcation of the existing Fair Price Shop.
The fact that the petitioner has filed an appeal against the order of bifurcation made by respondent No.1 and that the same is pending before respondent No.4 is not disputed by the learned Government Pleader for Civil Supplies.
In my opinion, if the newly created shop is allowed to come into existence pending the appeal, the appeal itself will become a fait accompli. In this view of the matter, respondent No.2 is directed not to finalise the selection and appointment of Fair Price Shop dealer for the newly created shop, pending disposal of the appeal by respondent No.4. Respondent No.4 is directed to dispose of the appeal within one month from the date of receipt of this order, after notice to the petitioner.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel, WPMP.No.39650 of 2014 filed by the petitioner for interim relief stands disposed of as infructuous.
