Heard learned counsel for the petitioner and Sri Rajesh Kumar Vidyarthi learned counsel who has appeared for the contesting Union respondents.
This writ petition has been preferred seeking the issuance of an appointment letter to the petitioner for the post of Constable CISF.
It is not disputed that although the petitioner was initially selected, certain discrepancies were noticed by the CISF which led to the referral of his application form as well as the answersheets to the Central Forensic Laboratory. Appended at page-25 of the writ petition is a communication dated 28 June 2018 in term of which the Dossier Scrutiny Board has apprised the petitioner that the Forensic Science Laboratory has opined that his writing and signatures do not match. According to Sri Vidyarthi, the allegation against the petitioner is of impersonation. He, however, submits that presently the Selection Board is yet to pass final orders pursuant to the receipt of the report of the Forensic Science Laboratory. According to Sri Vidyarthi the present writ petition has been preferred prematurely.
As this Court reads the communication at page 25, it is evident that till date no final orders adverse to the petitioner have been passed. All that the respondents have done is apprise the petitioner of the opinion of the Central Forensic Science Consequently, leaving it open to the petitioner to assail final orders that may be passed by the Commission now pursuant to the receipt of the aforementioned report, this writ petition is dismissed at this stage as being clearly premature.
