Heard learned counsel for the parties and perused the record.
By means of the present writ petition, the petitioner has sought following reliefs:-
"(i) Issue a writ, order or direction in the nature of mandamus directing to the respondent no.3 not to interfere in premises and provide facility according with law, in land no. 80, situated in--Nanpur Narayan Pur, Moradabad, (now presently-Moll-Asalatpura, Moradabad), which are allotted (indenture) by the Nagar Nigam Moradabad 0n 12.05.1991.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no.3 implement the provision of the act regarding slaughter house to said land, situated at Manpur Narayan Pur, Moll-Asalarpur, Moradabad, which are allotted (indenture) by the Nagar Nigam, Moradabad on 12.05.1991."
After arguing the matter for quite some time, learned counsel for the petitioner has confined his prayer to the extent that a direction be issued to the Respondent No. 3/concerned authority to decide the representation/application of the petitioner dated 18.01.2018 within a stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed of with a direction to the respondent no.3, Nagar Ayukt, Nagar Nigam Moradabad to decide the petitioner's representation / application dated 18.01.2018 expeditiously, in accordance with law.
