The petitioner has executed the work of N.H.47 ADB Aided Water Supply scheme-Construction of RCC ducts for crossing the road-Rectification for the damaged surface. The final bill was submitted by the petitioner after completion of the work. However, on account of pendency of certain vigilance enquiry in respect of another work executed by the petitioner, the payment has not been disbursed to the petitioner. The petitioner relies on Ext.P12, a communication sent by the Executive Engineer to the Chief Engineer, wherein request has been made to release the payment to the petitioner at the earliest.
Considering the fact that the petitioner has executed the work and pending bills being withheld for the reason of the W.P.(C) No.34794 of 2009 2 vigilance enquiry in respect of another work, there shall be a direction to the second respondent to release the final bill amount to the petitioner within a period of three weeks from the date of receipt of a copy of this judgment. The issue regarding interest is left open.
The writ petition is disposed of as above.
