GOVERNMENT PLEADER for Respondent(s) : 1 ­ 2. ========================================= CORAM : HONOURABLE MR.JUSTICE S.R.BRAHMBHATT Date : 24/07/2012 ORAL ORDER In this group of petitions, the mute question required to be answered is as to whether the petitioners were appointed in the first instance by an after the selection or some selection procedure by Centralized Recruitment Agency, working under the Centralized Recruitment Scheme for Non­Secretariat Clerks and Clerk­Typists' Vacancies. The petitioners in some of the petitions have claimed that they were infact selected through Centralized Recruitment Scheme by the Central Recruitment Selection Committee, and allocated to Tourism and other Department, where from they were required to be reallocated SCA/841/1995 2/2 ORDER to Sales Tax Department. If such is the case, then their first recruitment posting was in the Regional Department and afterwards they being reallocated to Sales Tax Department will have to be viewed as if it was a first clear occasion only. The Competent Officer in all these petitions therefore, would be the Officer or the Agency, which is called Centralized Recruiting Agency, in respect of all these petitions. Therefore, in all these petitions, the concerned Centralized Recruiting Agency or its Competent Officer will have to file an affidavit clarifying the stand in respect of the petitioners, who are claiming to have been recruited and/or selected and/or subjected to such selection procedure. The affidavits by Competent Officers of the concerned Centralized Recruitment Agency in respect of all these petitions shall be filed on or before 1st August, 2012. Copy thereof be served upon the learned AGP for its onwards transmission and compliance. The matter may come­up on 6th August, 2012. No further time should be granted on 6 th August, 2012 and the matter will be proceeded with irrespective of any sick report or leave report.
