JUDGMENT / ORDER

Petitioner challenges Ext.P7 demand notice issued by the Taluk Supply Officer calling upon him to pay the amount in terms with Ext.P4 order passed by the 1st respondent herein. A fine was imposed on the petitioner alleging violation of maintaining the accounts and displaying the same as contemplated under the procedure prescribed. Petitioner has preferred an appeal before the 2nd respondent which is pending consideration. In the meantime, according to the petitioner, there is a demand for payment of the aforesaid amount which is under challenge.
2. As matters stand now, Ext.P4 order is in force and therefore the petitioner is under obligation to remit the said amount. No doubt, remittance of the said amount will be subject to the result of the appeal pending before the 2nd respondent.
W.P.C.No.15596/2014 2 Under these circumstances, I do not intend to interfere with Ext.P7. However, it is made clear that remittance of the aforesaid amount of Rs.25,000/- shall be subject to the result of Ext.P6 appeal. Petitioner is granted one month’s time to remit the amount covered by Ext.P7.
