1.0 This application has been filed with a prayer to revive the main writ petition being Special Civil Application No. 5560 of 1998.
The main petition being Special Civil Application No. 5560 of 1990 was disposed of vide order dated 06.07.2010 in view of amicable settlement arrived at between the parties. Out of the four respondents, three respondents have accepted the settlement and amount was paid by the respondent-original petitioner. Since he applicant- respondent No. 5 has not accepted the settlement, he preferred the present application. It is apparent that the amount demanded by the applicant is unreasonable and contrary to the provisions of Industrial Disputes Act, 1947. In that view of the matter, I am not inclined to allow the application. The application is rejected.
2.1 The respondent shall make payment to the applicant by way of Demand Draft and it will be open tot he applicant to accept the said amount which is granted to the other three respondents.
