Heard learned counsel for the petitioner and Sri S.R. Singh for the respondents.
Petitioner is a retired employee of the U.P. State Road Transport Corporation. His Grievance is that the amount of gratuity paid to him is not in accordance with his entitlement.
Issues of facts, particularly quantification of the amount due and payable towards gratuity can more appropriately be examined by the competent authority under the Payment of Gratuity Act.
This petition, therefore, is not entertained while leaving it open for the petitioner to pursue his remedy under the Payment of Gratuity Act, 1972.
It is, however, provided that in case petitioner raises a grievance before the appropriate authority in respect of his entitlement to receive further amount towards gratuity, the same shall be dealt with, in accordance with law, expeditiously.
