1. After receiving instructions, learned Additional Chief Standing Counsel states that in respect of Khata Nos. 36 and 38, proceedings under Section 67 of U.P. Revenue Code, 2006 (hereinafter referred to as 'Code, 2006') are going on. So far as Khata No. 40 is concerned, there is no encroachment, as per the inspection made and report submitted by Lekhpal concerned, which is duly forwarded by Tehsildar, Soraon, Allahabad.
2. In view thereof, we do not find that any cause of action survives for entertaining this writ petition as Public Interest Litigation.
3. Dismissed accordingly.
4. A copy of instructions received by Additional Chief Standing Counsel has been placed before this Court and it shall form part of record of this petition.
