Heard learned counsel for the parties.
Learned counsel for the parties are agreed that the controversy involved in the present case is squarely covered by the judgment rendered in Writ A No. 22191 of 2018 (Hari Ram Yadav and 11 others Vs. State of U.P. and 2 others) on 24.10.2018 by passing following orders-
"1. Heard learned counsel for the petitioners, Sri Ashok Kumar Yadav, learned counsel for the respondent no.2 and learned Addl. Chief Standing Counsel for the respondent nos. 1 and 3.
2. This petition has been filed for issuance of writ of mandamus directing the Secretary, U.P. Basic Education Board, Allahabad to proceed further pursuant to notification dated 30.12.2016 to fill up 29,334 posts of Assistant Teacher (Mathematics and Science) in different Senior Basic Schools.
3. It is pointed out that similar controversy was raised before this Court in Writ Petition No. 27870 of 2017 (Neeraj Kumar Pandey & Another Vs. State Of U.P. & 3 Others) which was allowed on 03.11.2017. A special appeal arising out of such order has also been decided on 12.04.2018 following the directions issued in the aforesaid matters.
4. In such circumstances the present writ petition is also disposed of in terms of the directions issued by Division Bench judgment of this Court in Special Appeal No. 648 of 2017 (State Of U.P. Thru' Secy. Basic Education Govt. Of U.P.Vs. Neeraj Kumar Pandey & 4 Other) decided on 12.04.2018."
In the circumstances the present writ petition is also disposed of in terms of the directions issued by the Division Bench of this Court in Special Appeal No. 648 of 2017 (State of U.P. Thru. Secy. Basic Eduction Govt. of U.P. Vs. Neeraj Kumar Pandey & 4 others ) decided on 12.4.2018.
