Mayank Kumar Tyagi vs State Of U P And Others

High Court Of Judicature at Allahabad|23 August, 2018
|

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - C No. - 26925 of 2018 Petitioner :- Mayank Kumar Tyagi Respondent :- State Of U P And 2 Others Counsel for Petitioner :- Arun K. Singh Deshwal,Jitendra Kumar Shishodia Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J.
1. Heard Sri Arun Kumar Singh Deshwal, learned counsel for the petitioner and learned Standing Counsel for the respondent.
2. The petitioner had appeared in High School Examination in 2012. In the High School marks-sheet, his date of birth has been mentioned as "29.02.1997" though his correct date of birth is "19.02.1997". Even otherwise, in the year 1997 his date of birth could not be 29th February as in 1997, February was not of 29 days but of 28 days. Therefore, error in High School Examination certificate and mark sheet is apparent. The petitioner could detect the aforesaid error only when in February, 2018, he applied for recruitment of Constable in C.R.P.F., and, recognizing the said mistake by computer, petitioner's application was not accepted. Petitioner has already applied to the Board for making the aforesaid correction.
3. Learned Standing Counsel fairly stated that there is an apparent error and the same shall be looked into and appropriate action shall be taken.
3. Since error is apparent, in my view, this is an exceptional case in which Board of High School and Intermediate should proceed to do the needful within a month from the date of production of a certified copy of this order before him.
4. With the aforesaid observation, writ petition is disposed of.
