Learned counsel for the applicant submitted that the transfer application has become infructuous as the case has been decided. The appellant has been acquitted for offence under section 307 IPC while convicted for offence under Section 323 IPC.
Sri R.K. Gupta, learned counsel for the opposite party has no objection to the aforesaid argument of learned counsel for the applicant.
The transfer application is dismissed as infructuous.
