Heard Sri Rahul Chaudhary, learned counsel for the petitioner, Sri Arvind Kumar, learned counsel for respondent no.4, Sri N.K.Verma, learned A.G.A. appearing for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for quashing of the F.I.R. dated 9.6.2017, registered as case crime No.486 of 2017, under Section 406 I.P.C., P.S. NOIDA Sector-49, District Gautam Buddh Nagar on the basis of the deed of compromise arrived between the petitioner and respondent no.4 dated 4.9.2017.
Learned counsel for the petitioner submits that the petitioner and respondent no.4 have amicably settled their dispute and a compromise deed dated 4.9.2017 has been annexed with the writ petition as Annexure- 2, hence, FIR is liable to be quashed on the basis of the said compromise deed.
Learned counsel for respondent no.4 has admitted the fact of compromise entered into between the parties and submitted that he has no objection if the FIR be quashed.
Considered the submissions advanced by learned counsel for the parties.
In view of the above, it is apparent that parties have entered in to compromise and have settled their dispute amicably. Hence, considering the facts and circumstances of the case and nature of offence, the F.I.R. of the aforesaid case is hereby quashed. The present petition stands allowed.
