Heard learned counsel for the petitioner; learned AGA for the respondent nos. 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 09.01.2019 registered as Case Crime No. 0006 of 2019 at Police Station Nagina, District Bijnor, under Section 420 IPC and Sections 15(2) and 15(3) of the Indian Medical Council Act, 1956.
The allegation in the first information report is to the effect that a team visited clinic/hospital run by the petitioner and found that it was being run without any certificate of registration and compliance of other formalities.
The contention of learned counsel for the petitioner is that clinic/hospital has been registered in the name of Dr. Sonika and the petitioner is only an assistant there and, therefore, the allegations made in the first information report are false.
If that is so, then the proper course for the petitioner is to get the statement of Dr. Sonika recorded and produce the relevant document to show that the clinic/hospital had proper registration and was being run as per law.
With the aforesaid liberty, the petition is disposed off. Order Date :- 26.2.2019 Lbm/-
