This petition for writ is preferred to have an appropriate writ, order or direction for respondent no. 2 - District Magistrate, Deoria to consider and decide the case of the petitioner to have relief as per Rule 12 of the Schedule Castes and Schedule Tribes (Prevention of Atrocities), Rules 1995 (hereinafter referred to as "Rule of 1995").
The rule aforesaid prescribes the measures to be taken by the District Magistrate in pursuance of payment of compensation to a victim under the Schedule Castes and Schedule Tribes (Prevention of Atrocities), Act 1989.
As per learned counsel appearing on behalf of the petitioner, the petitioner has already submitted an application to have compensation as per Rule 12 aforesaid but no action thereon has yet been taken.
Having considered the facts stated above, we deem it appropriate to dispose of this petition for writ by directing the District Magistrate, Deoria to consider and decide the claim of the petitioner as per the Rules of 1995 within a period of 4 weeks from the date the petitioner presents a certified copy of this order before him along with a fresh representation pertaining to her claims.
The writ petition stands disposed of.
