The applicant is before this Court for a direction to initiate contempt proceeding against the opposite party for wilful disobedience of the judgement and order dated 13.3.2019 passed in Civil Misc. Writ Petition No.55353 of 2003 (Tejendra Pal Singh Vs. Cane Commissioner U.P. Lucknow and others).
It reveals from perusal of the record that against the aforesaid order special appeal being Special Appeal No.117 of 2020 was preferred by the State of U.P., which was dismissed by Division Bench of this Court vide order dated 11.2.2020.
Today when the matter is taken up, instructions received from the office of the opposite party was placed before this Court, same is taken on record. Copy of the same is provided to the counsel for the applicant. It appears from perusal of the record that a sum of Rs.1,22,813/-, which was retained/stopped was paid in favour of the petitioner.
In this view of the matter, Sri K. R. Singh, learned counsel for the applicant stated that since the order passed by the writ Court has already been complied with, therefore, no cause of action remained survive.
In view of the same, the present contempt application is disposed of permitting the applicant to make a fresh representation ventillating all her grievances before the authority concerned along-with copy of this order within a period of three weeks from today. If such a representation is made, the authority concerned is directed to pass appropriate order in accordance with law within a further period of four months.
