Mavoor Panchayath Small Scale ... vs The District Collector

High Court Of Kerala|26 April, 2000

JUDGMENT / ORDER

Petitioner is an Association of Bricks Manufacturers. They approached this Court challenging Ext.P6, an order passed by the Revenue Divisional Officer, requiring their members to stop manufacturing. It is stated that this order was issued taking note of the drought that was prevailing at that point of time.
2. When the writ petition was admitted taking note of the submissions made by both sides, this Court passed an order dated 26.03.2004 directing that the members of the petitioner will be permitted to continue their Brick Manufacturing activities provided, they possess all licences and clearances. It was also directed that in case, any violation of the Rules is noticed, it will be open to the authorities to initiate action after issuing notice to the concerned manufactures.
3. First of all, Ext.P6 order was issued directing that the petitioner shall not continue their operations unless they possess necessary licences. The specific case of the petitioner W.P.(C).No.10259/2004 : 2 : is that their members possess all licences and clearances. If that be so, so long as they are holding necessary licences, they are entitled to continue their manufacturing activities.
Clarifying the position as above, the writ petition is disposed of.
