By order dated 13.10.2017 in Writ-C No. 48242 of 2017, this Court directed the concerned authority to decide representation of the applicant for his appointment as Shahar Quazi within two months from the date of production of certified copy of the order.
The instant contempt application has been filed impleading one Avnish Kumar Avasthi, Secretary, Religious Task Department, Lucknow as sole opposite party.
Sri Neeraj Upadhyay, learned Additional Chief Standing Counsel has obtained instructions from the opposite party and according to which, opposite party is not the competent authority to examine the claim of the applicant, as the dispute does not pertain to his department but to the department of Minority Welfare.
Concededly, the applicant has not approached the Secretary of the Minority Welfare with his claim and in such view of the matter, this Court is not inclined to proceed in contempt against the opposite party.
The contempt application stands disposed of accordingly with liberty to the applicant to approach the competent authority and in that event, he shall ensure compliance of the direction issued by the Writ Court.
