The Court has passed the following order on 14.10.2014 :
"On the request of Sri Suresh Chandra Dwivedi, Advocate, put up day after tomorrow as fresh to enable him to look into the matter. We also direct the learned Standing Counsel to produce the record of the case on the said date and the District Supply Officer is directed to explain that when he has already passed one order on 27.5.2013 in pursuance of the order passed by this Court in Writ Petition No. 68571 of 2012, which has been upheld by the Division Bench of this Court in Writ petition No. 33062 of 2013, without complying with the direction how the order dated 16.7.2013 has been passed."
Sri Shobh Nath Sharma, learned Standing Counsel states that he is not aware about the order dated 14.10.2014. There is nothing in his file about the order dated 10.10.2014 and order dated 14.10.2014 and, therefore, he is not in a position to tell anything. It is very unfortunate that the Standing Counsel is not aware about the orders being passed by this Court and is not able to assist the Court.
Let the Chief Standing Counsel look into the matter at his own end and may see that the Standing Counsel posted in the Court should have full record of the case so that they may be able to assist the Court and no inconvenience may be caused to the Court.
In the facts and circumstances, the Court allows two weeks time to the Standing Counsel to file counter affidavit in the light of the direction given on 14.10.2014.
List on 10.11.2014 on the top of the list. Meanwhile, Sri S.C. Dwivedi appearing on behalf of respondent no. 4 may also file counter affidavit.
