The petitioner-society has been dissolved by the order dated 22.8.2019, passed by the respondent No.2. Against the said order, the petitioner has preferred appeal before the Joint Secretary Co-operative, UP, Lucknow, under Section 98 of the UP Co-operative Societies Act, 1965. The said appeal is pending and an application moved by the petitioner for interim protection filed therein had also not been considered.
In view of the above, the petitioner has filed this petition for a direction that his aforesaid appeal or at least the application for interim protection may be decided within a time-bound period.
In view of the limited prayer made in the petition, we dispose of the writ petition with the direction to the respondent No.1- Appellate Authority-cum-Joint Secretary, Co-operative, UP, Lucknow, to consider and decide the above appeal in accordance with law, most expeditiously, if possible, within a period of three months from the date, a certified copy of this order is produced before him. In case, for any reason, it is not possible to decide the same within the aforesaid period, he shall at least consider the application of the petitioner for interim protection and pass appropriate orders thereon.
The writ petition stands disposed of.
