Sri Akhilesh Kumar, learned counsel for the petitioner and Sri Girish Vishwakarma, learned Standing Counsel for the State.
Counsel for the petitioner submits that he is not pressing relief claimed in the writ petition and only seeks a direction to the District Magistrarte, Muzaffarnagar to decide the petitioner's representation dated 24.8.2020, Annexure-10, made against allotment of pond for the purpose of fisheries.
This innocuous prayer is not opposed by the learned Standing counsel.
In view of such facts, the writ petition can be disposed of with a direction to respondent no. 2, The District Magistrate, Muzaffarnagar to decide the aforesaid representation of the petitioner on its own merits, if possible, within a period of 90 days from the date of receipt of computer generated copy of the order being passed today in PDF form strictly in accordance with law.
In above terms, the writ petition is disposed of.
It is made clear that this Court has not expressed any opinion on the merits of the case.
