Heard learned counsel for the petitioner, learned A.G.A., and perused material on record.
This petition has been filed seeking direction to the respondent no.3-Sub-Divisional-Magistrate, Tehsil Soraon, District Prayagraj to implement the order dated 01.09.2021 passed in Case No.62 of 2020 (Matloob Khan Vs. Smt. Rizwana Bano), pending before learned Additional Civil Judge (Junior Division- II)/ Judicial Magistrate, Hapur, within stipulated period.
Perusal of the order dated 01.09.2021 shows that the Sub- Divisional-Magistrate, Tehsil Soraon, District Prayagraj has passed an order under Section 146 (1) Cr.P.C. and the petitioner by means of the instant petition has sought direction for the Sub-Divisional-Magistrate, Tehsil Soraon, District Prayagraj- respondent no.3 to implement the same.
Considering the fact, that the order was passed on 01.09.2021, without expressing any opinion on the merits of the case, this petition is finally disposed of with a direction that in case, the petitioner moves an appropriate application for implementation of the order dated 01.09.2021, if not yet implemented, before the respondent no.3 the same shall be considered and decided in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of one month from the date of production of a certified copy of this order before it, if there is no other legal impediment.
