Mathurbhai vs State

The prayer of the petitioner to direct the respondent No.4 to arrest the accused whose names are mentioned in the FIR being CR No.I-156/2010 and make proper investigation with regard to the said FIR, cannot be granted, at this stage, in exercise of extra-ordinary writ jurisdiction under Article 226 of the Constitution of India. However, it will be open for the petitioner to pursue remedy available under the Code of Criminal Procedure, 1973.

Accordingly, this petition stands dismissed.
