JUDGMENT / ORDER

The petitioner filed this contempt petition on allegation that the respondents failed to comply with the interim order dated 13 September 2013 in W.P.No.25667 of 2013.
2. The contention taken by the petitioner in this contempt petition is denied by the respondents in their counter affidavit. According to the respondents, the registration of the petitioner was cancelled and it was only after obtaining interim order, the petitioner started making claim that he should be permitted to do the business.
3. The issue raised by the petitioner cannot be decided in this contempt petition, in view of the stand taken by the respondents in their counter affidavit. I am therefore of the view that the writ petition itself should be heard on merits.
4. The Registry is directed to post the writ petition as early as possible and preferably by second week of March 2017 for final disposal before the appropriate Bench as per roster.
5. The closure of this contempt petition would not amount to acceptance of the case pleaded by the respondents in the counter affidavit.
6. The contempt petition is closed with the above observation.
