The petitioner claims to be the owner of 12.95 acres of land comprised in Survey No.103/7 of Edapally South Village in Kanayannur Taluk. According to the petitioner, this property is erroneously shown as 'nilam' in the Draft Data Bank prepared under Act 28 of 2008. The petitioner has approached the Local Level Monitoring Committee and submitted Ext.P5 representation to correct the entry in the Draft Data Bank. 2. According to the petitioner, this property has been reclaimed long ago, before enactment of Act 28 of 2008. The petitioner also relies on Ext.P4 report of the village officer to substantiate his claim that the property has been reclaimed before Act 28 of 2008.
3. In view of the pendency of Ext.P5 before the 2nd respondent, the 2nd respondent shall conduct the site inspection to find out whether the property was reclaimed before Act 28 of 2008. If the property has been reclaimed before enactment of W.P.(C) No.25783 of 2014

Act 28 of 2008, necessarily the entry in the Draft Data Bank has to be corrected.
Needful shall be done within a period of four weeks from the date of receipt of a copy of this judgment.
